Federal Lawsuit Against Act 10 Thrown Out

Act 10. Still legal. Still right. Still working.

MADISON – A federal judge on Wednesday threw out a lawsuit seeking to overturn former Gov. Scott Walker’s signature law that sharply limited collective bargaining for most public employees in Wisconsin.

The lawsuit over the law known as Act 10 was brought by two arms of the International Union of Operating Engineers after state and federal courts upheld the law in other cases. The union intends to file a new lawsuit, according to a motion filed by its attorneys.

Union officials filed the latest lawsuit in 2018, dropped it months later and revived it in May to name Democratic Gov. Tony Evers and Democratic Attorney General Josh Kaul as defendants.

U.S. District Judge Lynn Adelman agreed to throw out the lawsuit after Kaul in July argued the court did not have jurisdiction because the case had previously been closed.

Attorneys for the union agreed with Kaul and didn’t object to the lawsuit’s dismissal, according to court records.

  1. Mar

I’m pretty sure Adelman was greatly disappointed in ruling the way he did.

  2. Jason

Now let’s finish it off by applying it to the Police and Fireperson’s unions!

  3. dad29

No Republican has the balls to do that, Jason.  Just like Democrats, Republicans have double standards.  A few less, but……..

  4. Owen

Agreed. If Evers were smart, he would push for the expansion of Act 10 to these unions because that was one of the alleged criticisms of it. He could be a champion for consistency in the application of government regulations.

  5. Le Roi du Nord

Odd nobody here praised Kaul. If it had been schimel you guys would have been fawning all over him.

  6. Merlin

Praise Kaul for what? Successfully finding a way out of having to officially defend Act 10? IUOE threw a brother a lifeline. Nice catch.

  7. Pat

I’d love to see the Republicans create and pass a bill to expand act10 to include the police and firemen and slap that down on Ever’s desk for him to sign. Alas, they don’t have the guts.

  8. Kevin Scheunemann

Evers has to signal he will sign it.

Evers opposed it in the past.

So it is not worth time unless Evers says he will sign it.

  9. Pat

    They should take a stand.

  10. Kevin Scheunemann

    Evers should take a stand.

  11. Pat

Send him a bill. If he vetos it, they should over ride it.

  12. Kevin Scheunemann

Not enough votes to override in Senate.

Let’s see a Democrat finally stand for fiscal responsibility…

  13. Kevin Scheunemann

    Off topic again.

I applaud Kremer for blocking liberal hate groups on his Twitter feed.

I wouldn’t want trash on my Twitter feed…if I had one.

  14. Le Roi du Nord

You brought up fiscal responsibility, not me (see above).

And does freedom of speech only apply to those you deem worthy?

Such hypocrisy and double standards. Awful just awful.

  15. Kevin Scheunemann

So politician has no ability to weed out their Twitter feed for trash and decorum for kids on feed?

What if there is cuss words?

    Rape fantasies?

    LGTB graphic detail?

Politician can’t censor liberal perversion at all on his feed geared toward families?

Not surprised you fail to embrace basic decency.

  16. Le Roi du Nord

Better not lecture us on freedom of speech unless you really mean it. Or is your goal censoring all those with differing viewpoints?

  17. Kevin Scheunemann

I am saying we have a duty, of any speech portals we control, to have a sense of decency.

Not going to allow the local Satan temple to hang a sign for their animal sacrifice ritual on the door at DQ.

Owen has excised people here behaving badly.

Freedom of speech is about government chilling speech.    I view a politicians twitter feed to be their twitter feed to regulate as a private property matter.   Politicians have an interest to make their twitter feed safe from liberal perversity.    I have been kicked off many liberals political portals, some locally.   And I do not speak any perversions. I suggest you lecture local progressives if you are interested in civility.

Progressives excise people for rational thought and logic.

  18. jjf

Satanists hanging a sign on the door of a DQ, just to attract attention and controversy?  Who can imagine anyone doing such a thing?

And tweets!  What if the tweets contained poor grammar or spelling errors?  Perversions!  Down on your knees, making you think about all those perversions!

  19. Jason

    >You mean fiscally responsible like these R’s?

More “whataboutism” that isn’t relevant to the discussion.  Poor liberal troll is really struggling these past couple months.

  20. Kevin Scheunemann

Unlike liberals, I am anti-Satanist.   Nord’s statement makes no provision for decency on discussion portals one is in charge of.

Using the Signs on my door at DQ as an example.

Should public officials allow pro-liberal satanists to tweet about their animal sacrifice event on their twitter feed?

    I say no.

Just curious what say you, pro-Satanist, or not?

  21. jjf

Kevin, if I explain how Twitter works, will you give me a coupon for a Buster Bar?

Jason, I look forward to your future detection of “whataboutism” no matter where it appears.

  22. Le Roi du Nord

“Freedom of speech is about government chilling speech”.

And that is what vos and nygren did.

  23. Jason

    >Jason, I look forward to your future detection of “whataboutism” no matter where it appears.

Sorry nutjob, unlike you, I don’t have some fetish to point things it out, “no matter where it appears”.  I just like pointing out your idiocy for us all to titter at.

  24. jjf

OK, Jason, maybe you can explain Twitter to Kevin.

  25. Kevin Scheunemann

So you both are fine with Satanists tweeting their animal sacrifice ritual date and times?

The public official can’t block evil and liberal trash on the feed?

Sounds like a special kind of torturous purgatory liberals want to subject rational public officials to.

  26. Le Roi du Nord

You said it yourself, “Freedom of speech is about government chilling speech”.  vos and nygren are R leaders. Your hypocrisy knows no bounds.

  27. Kevin Scheunemann

Satanists and liberals with child rape fantasies still have freedom of speech, they just can’t do it on twitter feeds.

Decency should be standard on a twitter feed. Besides, twitter does that now, in their sick and inconsistent liberal morality. I see you are fine with that.

  28. Le Roi du Nord

Were those the type of things One Wisconsin put on vos and nygrens twitter ?  Or are making stuff up again?  Perhaps you could provide the text of those twitter feeds.  Remember, truth is your friend.

  29. Kevin Scheunemann

I’m saying if you acknowledge a certain disgust must be weeded out of a Twitter feed… it is up to the person, running the feed, to weed or block the trash from their feed.

Twitter does it all the time and declares simple conservative speech trash and bans, expels, and suspends conservatives all the time!

So the worst liberal perversion must stand in your view, but simple conservative viewpoints can be punished?

I failed to see any outrage over Twitter’s actions against honest conservative speech being banned.

    Your position disgusts me.

  30. Le Roi du Nord

So you can’t back up your claims, can’t provide the accurate quotes, and admit you made it all up to make yourself feel more important, right?   In other words, you lied.

  31. Mar

Don’t forget about Facebook. They remove many conservative posts and videos, including removing numerous Trump videos during the 2016 election.

  32. Kevin Scheunemann

Not about me, it is about your tolerance of open perversion.

  33. Le Roi du Nord

You made it about yourself with your untruthful accusations.  Where did I ever say I am tolerant of perversion?  You are making stuff up again.

  34. Kevin Scheunemann

I am saying leftists at Facebook, Twitter, etc can censor rational conservative content and label it “hate”, with hardly a peep from you…why can’t conservatives clean up real hate and actual perversion: liberal speech on their twitter feed.

    Double standard you have there.

  35. Le Roi du Nord

Show us all some “rational” conservative content.  Like how the earth is 6000 years old, or how the Revolutionary  Army captured the British airports, or maybe explain how rational alternative facts are…..  Dare ya.

  36. Mar

“You made it about yourself with your untruthful accusations. Where did I ever say I am tolerant of perversion?”
Uneducated Le Roi, if you are a true liberal, you do support racism, bigotry, elitism, and some kinds of pervision.

  37. Kevin Scheunemann

My faith in Christ allows me to believe that. Why is it so impossible to believe scientists can be wrong? They are constantly re-writing the “truth” as they discover new things. Also, God may have created an aged earth to test our faith. To see how far the godless will take their godlessbess in rejecting God.

Of course Trump was dumb for saying the revolutionary war comnent. He was being Trymp, no one takes that comment seriously, except wacked out radical leftists with no sense of humor.

What Barnes did is being taken seriously by Evers.

Get some perspective in your radical liberal religion.

  38. Le Roi du Nord

What an interesting insight into your mindset; where your “faith” allows you to subscribe to and promote intentional falsehoods and lies.  This is the first time I have ever heard that religion allows true believers to lie, and that promoting those lies is encouraged.  That explains a lot about how the so-called religious right continues to promote serial liars.  Thanks for that interesting bit of detail into how your “faith” is destroying honesty in our country.

And I wish the old priest at my grade school was still around.  He no doubt would give you the old hell and brimstone lecture on sinning.

  39. Kevin Scheunemann

What you just said was insulting to every true bible believing Christian.

    Why do you constantly hate?

  40. Le Roi du Nord

And your rationale and justification for promoting dishonesty is an insult to every rational being on earth.  And you earned it .

  41. Kevin Scheunemann

Rational?   You have never, ever answered the simple question, “where did all the material leading up to the Big Bang come from?”

Many rational scientists admit divine intervention is needed to make Evolution/Big Bang theory work…and make sense.

Try some tolerance in your rigid, man made, Big Bang cult.

  42. Le Roi du Nord

I don’t know, nor do you.  But you continue to make up fictional accounts about how the earth is 6000 years old, whereas I have to courage to say, “I don’t know, but I believe someday smart folks will figure it out”.

Could you name some of those “rational scientists” that believe that.  Make sure they are also reputable and qualified to make such a claim.

No cults involved.  But you know that already.

  43. Kevin Scheunemann

If you don’t know how all matter came into being….why do you harshly criticize and ridicule Christians that do?

Try some tolerance since you admit you can’t prove how universe came into being.

That would be rational thing to do.

When you say the “smart folks” will figure it out someday, isn’t that “faith”?

Glad you admit your faith, finally.

  44. Le Roi du Nord

Because folks like you claim to know the truth, when in reality you have less than any knowledge on the subject. When you say something that is easily proven wrong, like “the earth is 6000 years old”, then continue down the path of ignorance you put yourself in a position of extremely low credibility.

I have no tolerance for lying, nor for willful ignorance.  I believe that anyone and everyone can improve their knowledge base.  For folks like you that chose willful, active, and participatory ignorance, then defend themselves with dishonesty I have no tolerance.  To ignore you and your ilk would be an insult to every teacher, professor, co-worker, friend, or wise person I have ever learned from.  I know of no one that would think that ignoring your behavior would be a “rational” act, but rather one of cowardice.

  45. jjf

See, Le Roi, Kevin’s all about the tolerance.

  46. Mar

“I have no tolerance for lying, nor for willful ignorance.”
Bahahaha, Funny Uneducated Le Roi, thanks for the laugh.

  47. Kevin Scheunemann

You would be lying when you claim to know the proof of the orgin of the universe.   What you have is faith, that flawed mankind wil figure it out someday.

You have faith in wrong things.

    That is not rational.

You are free to have faith in flawed mankind…my beef is the harsh, hateful words you have for Christians for knowing how the world came into being.

You are awfully intolerant for someone who does not have the issue figured out themselves.

  48. Le Roi du Nord

And where did I make that claim?  Use the exact quote.

And how on earth would you know the difference between right and wrong?

Well, you claim your faith allows you to believe the earth is 6000 years old.  Now that isn’t rational.

So share with us that knowledge of how the earth came into being.  But use facts, not a 2000+ year old quote from a book of tall tales.
