Governor Evers Talks Tough

This has been entertaining to follow the back and forth the past few days. Notice how Scott Bauer from the AP continues to just regurgitate the spin and lies from Evers. Evers’ “guidance” was nothing of the sort. It was written as an instruction – one might even call it an order. I’m pretty sure that the Trump Administration wouldn’t arrest a sitting governor, but we can expect to see some government employees in cuffs if they follow Evers’ instructions.

MADISON, Wis. (AP) — Wisconsin Gov. Tony Evers said Friday that every American should be concerned about “chilling” suggestions from President Donald Trump’s top border adviser that he could be arrested over guidance the Democrat issued to state employees about what to do if confronted by federal immigration agents.

 

“I’m not afraid,” Evers said in the extraordinary video posted on YouTube. “I’ve never once been discouraged from doing the right thing and I will not start today.”

 

At issue is guidance Evers’ administration issued last month in response to state workers who asked what they should do if agents with U.S. Immigration and Customs Enforcement show up at their offices.

Evers’ guidance advised them to contact an attorney immediately and ask the officers to return if an attorney is unavailable. The memo also advises state workers not to turn over paper files or give ICE officers access to computers without first consulting the state agency’s attorney and not to answer questions from the agents.

    We need a DA to conduct a John Doe on Evers for misconduct in public office. Telling people to obstruct service of a warrant is clearly illegal and subjects them to arrest for obstruction.

    Unlike the Scott Walker John Doe this would actually have a criminal basis. It wouldn’t take a bunch of 6AM raids on his supporters accompanied by the media to accomplish either.

    Instructions for State Employees Encountering ICE or Other Federal Agents at Their Workplace

    Here is the salient text:

    3. Call your Office of Legal Counsel and speak directly with an attorney.
    a. This applies regardless of whether or not the agent has presented a judicial or administrative
    warrant.
    b. If you do not reach an attorney, ask the agent to come back at another time after you have
    been able to consult with your attorney.
    [ This is at face illegal. You don’t get to choose to comply with a warrant, attorney present or not]

    4. Do NOT do any of the following:
    a. Do not answer questions, including when an agent asks about someone you know or
    presents a warrant with an individual name.
    b. Do not give the agent access to any paper files or computer systems without speaking to
    your attorney, including when the agent presents a warrant.
    c. Do not give your consent for the agent to enter into a non-public area.
    i. The agent must have a judicial warrant to do this, and your attorney will advise you on
    what areas are covered by a warrant.
    ii. Examples of public areas include reception, waiting areas and lobbies, restrooms
    available to the public, and other common areas accessible by members of the
    public without screening or escort.

    Try disobeying your boss’ instructions. 4b says to obstruct an agent with a warrant. Law enforcement doesn’t wait for an attorney to show up when serving a warrant.
    Evers putting out an “instruction” gives this the force of a workplace policy and people get fired for violating policy.
