Actually, the flag thing bothered me. It didn’t look to me like it was clothing. It looked like a flag with a slit cut in the center. It was ragged and unkempt, and should have been separated into it’s main components and burned. But instead it was worn by a sweaty little man, ripped off, tossed to a guitarist, and put down on a speaker. And I’m sorry if people from other countries don’t understand why we have respect for our flag, we just do. We also have a lot of traditions surrounding it, although most people aren’t aware of them anymore, ask any member of the Armed Services how to dispose of a flag though, and they’ll tell you. Oh, and by the way, Air Force personnel officers make me laugh. I’ll salute you and call you Sir, but don’t pretend that you’re hardcore.

I’m European, German by the way....
I grew up partly in the US and in the States. And I had to go to school there with all the flag showings, and morning pledges.
Now, thats 20 years gone.
I still feel sick about the pledge of allegiance, or what it’s called. Every day that I get to grow older and see what injustice your country brings upon the world makes me want to vomit even more.
You call yourself a great nation ??? By what fucking standards, anyway ??
By polluting the environment of the entire with your crappy cars, consuming more fuel that all of the rest of the world ??
By destroying natural habitats, life and peoples home thru your oil companies in South America or the Anarctic ? Because at home, you’d get in trouble doing so or being called unpatriotic ??
Or is it by invading countries that have a despotic regime with faked proof of weapons that never existed ? Just to live the “American Dream” = we rule the world, and let’s not stop us from making money with others people’s resources…

I didn’t watch the game. I hate football. I did watch the half time show when I heard Janet. I do like her. When her breast was revealed it was a shock but I was not upset about it. I knew it was going to be top news. I do think it was on purpose and a publicity stunt it took the attention away from Michael. It worked. Should Janet be fined?, I don’t think so when you compare it to all the other things on television. I’ve seen worse things on soap operas. What you should be concerned about is the Federal Reserve Bank with there Fiat money.It robbes this country of it’s wealth. Causing inflation you know, lose of purchasing power. People our dollar hasen’t been backed by precious metals since 1963. Now that is an outrage.

I’m a little surprised that you would even argue the point that there isn’t a problem with frivolous lawsuits.  The problem with them are <a target="_blank" href="http://msnbc.msn.com/id/3660738/">all around us.</a> But the problem isn’t just the actual lawsuits, it is the <a target="_blank" href="http://headaches.about.com/cs/advocacy/a/lamus_cala.ht m">fear of the lawsuits</a>.  The costs of this fear are built into every product and every service.  Doctors charge more for their services to cover the cost of their high malpractice insurance.  Consumer products cost more to cover the cost of possible litigation when people misuse their products.  It’s everywhere. 

Let’s take a look at your study.  The fact that only 10% of injured parties sue is irrelevant.  They are legitimately injured and should seek compensation.  Their suits aren’t frivolous.  The low number points to a problem, but not this one.

The fact that jury awards have kept pace with inflation is a dubious statistic.  I’d like to see the methodology.  But it doesn’t matter if 99.9% of lawsuits are resolved within reasonable limits.  It’s the fear of being in the 0.1% that makes people and companies react.  Furthermore, it doesn’t matter if an award is within some financial reasonableness if the award is based on a frivolous claim.  Too many times, frivolous claims win because it gets before a sympathetic (or pathetic) jury that feels bad for the wheezing old lady instead of actually looking at the law.  It is up to the judge to prevent bad cases from ever getting in front of a jury. 

As far as most cases being the product of contract disputes and such, who cares?  Again, those are legitimate cases for which the court system was designed.  It does not address the issue of frivolous lawsuits.

A huge example of this problem are the tobacco suits.  Most of the cases against the tobacco companies were completely frivolous.  Yet, judges eventually let them get to juries.  The juries only saw a mean ol’ corporation fighting against a little old man talking through a tube in his neck and felt sorry for him.  The result was hundreds of billions of dollars in awards.  You may think that this is no big deal because the tobacco companies are evil and only other smokers will have to pay higher costs and they may quit because of it, which is a good thing, but you would be wrong to think that.  The tobacco lawsuits are having effects far beyond their industry.  Do you not think that the food industry, gun industry, alcohol industry, the automobile industry, and just about every other industry isn’t building up their legal defenses already?  The costs for their lawyers are already being seen in the price of just about everything you buy.  This is having such an effect because the grounds upon which the tobacco lawsuits were based were total crap - for lack of a better word.  All of this has a real effect on lives.  There are fewer jobs, the cost of insurance continues to rise, and taxes go up all because of the pervasive fear of frivolous lawsuits.

Beyond the financial impact of these suits is the general impact on our culture.  We are inundated with warning labels that insult the intelligence of any higher order mammal.  We have to question whether or not we might be sued before helping a person having a heart attack. We hesitate to loan our hedge trimmer to the neighbor because of a fear that he might sue if injured.  The lawsuits themselves, and the fear they generate, have seeped into almost everything we do.  We must put an end to it.

Did you have to answer questions from your daughter the first time she saw the two girls mud wrestle and fountain wrestle after taking off their clothes in slow motion and yelling, “taste great, less filling”? A thirty second commercial played over and over again?
Did you get a stared and confused look from your daughter when she watched the girl ride the mechanical bull eating a Carl’s Jr. burger? Another thirty second commercial played over and over again during many football games.
Does your daughter ever ask why coaches and players sometimes get away with yelling profanities by “mistake” into open microphones during the game, or when a coach yells, “what the F--K” and the commentators call that replay up with no audio and say, “I think you know what he said.”
Gimme a break Dave, we are immoral but you already expose your eight year old daughter to sex, profanity, and violence. You don’t think she gets it, the commercials, the replays, the athletes cussing, and the scantily clad cheerleaders, all just a prelude to what Janet and Justin did. And if by any chance the entire boob showing was a mistake, then the repurcussions should be the same for when it is a mistake to hear a player yell, “bullshit” after a penalty is called on him. Dave ask yourself, was it seeing the boob that made you angry, or the way the boob was displayed in a sexy way? I think it is the ladder because I am sure your daughter has seen a boob before, but seeing it displayed with that kind of dancing, well the commercials, pg13 movies, and games give you all the same acts without the actual less than a second blurb of a semi covered boob.
And one more question Dave, has your daughter ever seen you speed without getting a ticket, roll through a stop sign with out getting a ticket, double park, comeback to an expired meter without a ticket, litter? Has your daughter seen you break any of these laws without repurcussions? MORALS DAVE, WHERE DID THEY GO?

Hope - the mere fact that so many ridiculous lawsuits get through the courts and sent to a jury tells me that the judges are unwilling to throw out the bad ones.

Honestly, I’ve heard numerous reform suggestions and I’m not sure of the best way to reform the system.  Perhaps a law where if your lawsuit gets thrown out for being frivolous, the lawyer (not the plaintiff) is charged court costs and legal fees for both sides.  And perhaps if a lawyer has 5 cases thrown out for being frivolous withing 5 years, they should be disbarred.  Perhaps appointed judges should face automatic impeachment hearings if an appeals court throws out the case for being frivolous. 

I’m not sure how to fix it, but it’s broken.  We should take a serious look at really fixing it rather than going for the duct tape and bailing wire solution of protecting target industries like the food, alcohol, guns, etc. industries.  Furthermore, there could be undesirable side effects if the laws protecting these industries are poorly written.  They could end up being immune from legitimate lawsuits, which would thwart justice for the suing parties.

I dont think its a question of ability. The courts have every power to throw out ludicrous lawsuits. However, there is no precendent for them using these powers. Any judge with a nickel’s worth of common sense can tell the difference between people looking for a free ride at the expense of the consumer base and people with legitimate grievances. For any number of reasons they choose to indulge these idiots.

Until you can somehow find a way to instill reason into the minds of those that make these decisions, it seems to me that this is the only way to prevent frivolous lawsuits from actually getting past wrong-headed and corrupt judges.

But, seriously, I think it is rediculous to cite specific laws. I sincerely doubt that anyone save lawyers or law makers can correctly identify and cite laws, other than traffic violations perhaps. Specific identification can only come from the actual bill that was passed, and I don’t have that information on hand.

I was under the impression that the display at half time violated FCC nudity rules. The main reason for this assumption on my part is the fact that there was talk of fining CBS or MTV. I’m not sure why the FCC would fine someone who didn’t break a regulation.

If, indeed, they didn’t break the law, then I have no objection, besides my own opinion that it was tacky. But thats fine, people can be tacky. It doesn’t really elicit a response from me besides a shake of the head. 

I don’t care what law (if any) they violated, be it language, nudity, or any other of the plethora of regulations enforced by the FCC on the part of the people of the US. The nudity isn’t important; obeying the law is.
