Wisconsin hits the national news again.

Wisconsin law bans sex with dead bodies, the state Supreme Court ruled Wednesday in reinstating charges against three men accused of digging up a corpse so one of them could have sex with it.
The court waded into the grisly case after lower court judges ruled nothing in state law banned necrophilia. Those decisions prompted public outrage and a push by a state lawmaker to make sex with a corpse a crime.
In Wednesday’s 5-2 decision, the high court said Wisconsin law makes sex acts with dead people illegal because they are unable to give consent.

Secondly, the dissent by Justice Bradley is both hilarious and dead-on. Why didn’t the Legislature just take care of this? Once again, a liberal justice stands up against judicial activism… ![]()

Not that they’ll be interviewing for a job anytime soon (except perhaps for that of boy toy in prison) but when/if they’re ever released they should be placed on some sort of permanent “do not hire” roster that potential employers can reference to ensure that this human debris never ends up working for them.

I am glad the court could clarify that we aren’t supposed to have sex with dead people. Now maybe they can clarify if it is illegal to have sex with a dead deer.

What is the motivation here? Do these judges feel compelled to stretch a law to acheive the desired result in this situation?
Wouldn’t it be the easiest bill in the world to pass to introduce legislation banning necrophilia?
There are other charges that these kids have been charged with, they aren’t walking free.
Why not do the right thing and let the legislature quickly take care of this situation.
Perhaps the justices are scared of the court of public opinion and the manner in which a largely uninformed public would be swayed by future campaign commercials that would state “Justice X’s decision set a necrophiliac free”
Actually, I agree too. The court overreached here and the legislature is negligent in making necrophilia illegal.
I just think it’s sad that these are the kind of stories about Wisconsin that keep hitting the national press.

I can’t answer this question because I’m part of the demographic, but I wonder if we hit the news more than other states with these kinds of disgusting embarrasing deviant behavior stories or if we just notice more because its our own state.
Again, I can’t answer that question but… I am sure wisconsin doesn’t corner the market on freaks.
It is hard to judge because we live here, but it seems to me that Wisconsin is in the national news more than your average state.
I don’t think we have the freak market cornered, but I do think the rest of the country has some sort of strange fascination with Wisconsin. Look at all the television shows that have been set in WI (from Happy Days to the 70’s show).
Our supremes must be nuts in saying sex with a corpse is illegal because a corpse is unable to give consent. A bad stretch of the law. Criminal laws are to be interpreted closely and not stretched as it’s wrong to apply criminal punishment to acts not contemplated by the legislature.
These mugs are already charged with grave robbing and other charges. Let the legislature pass a new law on no sex with dead people if that’s needed. Dead people, ugh!
Being from Wisconsin, I think there is a tendancy to pay more attention to WI news & kind of gloss over what I see about other states. I did a news search for term “necrophilia” and got 5 pages, all related to this item only.
Of course, WI is infamous for Ed Gein & Jeffery Dahmer. However, not that many years ago, someone was discovered in England who made Dahmer look “minor league”.
In the big scheme of things, this is only one news cycle - this will be forgotten real soon.
I have to go now, but when I get back, I expect to see some kind of comments about how this decision is proof that Judge Ziegler did this to help her fat-cat contributors. I mean, here we are at 12+ comments, and nothing on that yet.

A corpse is not a person, but rather an object.
The legislature and the courts should just man up, and admit that they were asleep at the switch, and fix the law after the fact.

Not going to even try to rationalize necrophilia, but just looking strictly at the construction of the law in question (which IMO is all that the supremes should be doing) Kristopher has it right in 15.
When does a person cease to be a person? In the case in question, the act took place days after the body was interred. This is not a person, so no portion of the law in question should apply.
As disgusting as I find the act, I would have to agree that without legislative action, this is going to be overturned at the federal level.
