Judgment In Favor of Open Carry

Judgment.

IT IS ORDERED that judgment in the amount of $10,000.00, inclusive of attorney’s fees and costs, is entered in favor of plaintiffs, Wisconsin Carry, Inc., and Frank Hannan Rock and against defendants, City of Racine, Sgt. Nethery, and R. Prince, as to all claims of said plaintiffs, state and federal, respecting this action.

  1. More people are exercising their right to openly carry a sidearm every day in Wisconsin.  Unfortunately, there are in almost every police department or agency a few rogue officers who think they will decide which civil and Constitutional rights individuals will be allowed to exercise.  They will have to learn the hard way as in this case.  Legal precedent has been set in other states already for these rogue officers to actually lose their qualified immunity and then be sued as individuals. Harassment under color of law needs to be dealt with severely.  While I and all other open carriers are big supporters of the police, we also demand that they respect our rights and realize they don’t decide which of them I may exercise.

    If Wisconsin’s municipalities find open carry so distasteful and disturbing, then they should push the state to join the other 48 that allow concealed carry with a license. If the problem is that the visible weapon causes a public stir, then allow me to carry it where no one can see it.

Family Guy, you are sorta on the right track.  Open carry is legal in 40 states!  Why would we want to give up that method of carry in Wisconsin?  For instance, in MN the permit is a “Permit to Carry”, not a “concealed carry permit”.  The mechanics of how you carry are left up to you, as a free man/woman.  After doing open carry everywhere I go in Wisconsin (where it is lawful) since last April 20th (when Van Hollen’s opinion came out) I have come to like it and prefer it to concealed carry.  I have permits that allow me to carry concealed or open in 30 states and have now done a lot of each.  The few states that do have concealed carry only have growing movements to change their laws to allow open carry as well, most notably Texas.

    Not once in all this time of doing open carry has even one person “freaked out” as Jeff Wagner maintained on his radio show recently.  It just doesn’t happen.
