I love how the law works sometimes.
A Texas woman who caused her lover’s shooting death by falsely crying rape was convicted Friday of involuntary manslaughter.
Tracy Denise Roberson, 37, cried a bit when the verdict was announced. The punishment phase was set for Monday, and she faces two to 20 years in prison.
In late 2006, Darrell Roberson came home from a late-night card game to find his scantily clad wife with another man in a pickup truck in the driveway. Tracy Roberson was with her lover but cried rape, and her husband fired four shots into the truck as Devin LaSalle drove off, killing him.
Darrell Roberson initially was arrested, but a murder charge was later dropped and a grand jury indicted Tracy Roberson instead.
I’m as happy as the next person that she’s going up state for 20 years over this, she’s certainly culpable.
But he really gets off with nothing? He shoots a man fleeing his property, and there are no consequences?
Posted by on May 03, 2008 at 1140 hrsWhy would there be consequences? He is a suspected rapist at this point, and one thing the article does not say is whether the wife was still in the truck or not at that point.
Posted by on May 03, 2008 at 1222 hrsAny man running away after raping my wife would got shot as well. No and, if’s or buts about it. I find it a little outragous that anyone would hesitate.
This guy got used in a terrable way. I’d bet he punishes himself pretty thuroughly. I am thrilled he didnt end up culpable.
Posted by on May 03, 2008 at 1227 hrsIt’s typical that the man gets a lighter rap than the woman. Look at the Vitter case. He gets a scolding, she ends up getting convicted and then committing suicide. How’s that work?
Posted by capper on May 03, 2008 at 1235 hrscapper - I think that’s more of a “user vs. supplier” difference than a man vs. woman one. If the senator was doing drugs, he’d get a lesser sentence than the dealer who was doing the distributing. Unless, of course, you think that everybody who gets caught with a little weed should be charged the same as dealers.
Posted by Fuzz on May 03, 2008 at 1254 hrsHe was hiring a prostitute, which is illegal. Why was she prosecuted, but he wasn’t? He wasn’t a witness, that I’m aware of, so why did he get off so light?
And why not charge users, if your going to charge dealers? Illegal is illegal.

When you put all the legal BS aside...the scales of justice are sometimes balanced.
Posted by on May 03, 2008 at 1948 hrsCapper, how is it ‘typical’ that a man got a lesser charge here? Can you cite any apples to apples cases? I just don’t remember any cases recently where a woman shot a fleeing woman because her husband was yelling rape in his underpants… Now I have heard where the husband was shot by the wife, but I don’t think that proves your point very well. Husband, wife, and another man… a man gets shot. Husband, wife and another woman… a man gets shot. We men come out so far ahead.
