The City of Milwaukee’s attempts to recover $52.6 million in damages from a company that manufactured lead for use in household paint failed again on Tuesday, when a state appeals court affirmed a jury’s verdict in the seven-year-old lawsuit.
By a 2-1 vote, the court found sufficient evidence supported the jury finding: that lead paint in thousands of houses in Milwaukee presented a public nuisance, but that NL Industries did not cause the nuisance, either negligently or intentionally.
